Licenses.

Lite is free for noncommercial use and for evaluation. Any commercial use, of either edition, needs a Pro subscription for each developer. This summary helps you find your case; the full texts below are what applies.

SuperScheduler Lite

PolyForm Noncommercial 1.0.0 or PolyForm Free Trial 1.0.0, at your choice. Source-available, not open source.

Free

  • Personal use and any other noncommercial purpose: study, research, hobby projects, testing.
  • Use by charities, educational institutions, public research, public safety or health and environmental organizations, and government institutions, whatever their funding.
  • Evaluating whether Lite suits a particular application for less than 32 consecutive days, also on behalf of a company, without distributing it.

Needs Pro

  • Any other use, including use in or for software, websites or services that are sold or that support a commercial activity: one Pro subscription for each developer who works with it.

SuperScheduler Pro

SuperScheduler Pro License Agreement: a yearly subscription for each developer.

Who needs one
Each developer who writes, changes or maintains code that uses SuperScheduler. Build and test servers, and the people who use your application, do not. A subscription can move to another developer when the first one stops working with it.
Price
€499 per developer for twelve months, plus applicable taxes, paid in advance against an invoice. Fees are not refundable, except where the law requires otherwise.
What it allows
Developing, testing, building and running your own applications, commercial ones included, and shipping the library inside them in the form your build produces. Your end users need no license. It also covers commercial use of Lite by the same developers.
What it does not allow
Distributing the library on its own or inside a component, framework, template or SDK for other developers; building a competing scheduler, timeline or calendar component; publishing its source, packages or download keys.
When it ends
If the subscription is not renewed, every right ends, including use in applications already in production: you must stop using and distributing the library and delete your copies, unless another license allows that use.
Updates
You may download the versions released while your subscription runs.
Licensor and law
The licensor is Enrique Pina. The agreement is for business and professional use and is governed by Spanish law. The software is provided as is, without warranty.

Acceptance

In order to get any license under these terms, you must agree to them as both strict obligations and conditions to all your licenses.

The licensor grants you a copyright license for the software to do everything you might do with the software that would otherwise infringe the licensor's copyright in it for any permitted purpose. However, you may only distribute the software according to Distribution License and make changes or new works based on the software according to Changes and New Works License.

Distribution License

The licensor grants you an additional copyright license to distribute copies of the software. Your license to distribute covers distributing the software with changes and new works permitted by Changes and New Works License.

Notices

You must ensure that anyone who gets a copy of any part of the software from you also gets a copy of these terms or the URL for them above, as well as copies of any plain-text lines beginning with Required Notice: that the licensor provided with the software. For example:

Changes and New Works License

The licensor grants you an additional copyright license to make changes and new works based on the software for any permitted purpose.

Patent License

The licensor grants you a patent license for the software that covers patent claims the licensor can license, or becomes able to license, that you would infringe by using the software.

Noncommercial Purposes

Any noncommercial purpose is a permitted purpose.

Personal Uses

Personal use for research, experiment, and testing for the benefit of public knowledge, personal study, private entertainment, hobby projects, amateur pursuits, or religious observance, without any anticipated commercial application, is use for a permitted purpose.

Noncommercial Organizations

Use by any charitable organization, educational institution, public research organization, public safety or health organization, environmental protection organization, or government institution is use for a permitted purpose regardless of the source of funding or obligations resulting from the funding.

Fair Use

You may have "fair use" rights for the software under the law. These terms do not limit them.

No Other Rights

These terms do not allow you to sublicense or transfer any of your licenses to anyone else, or prevent the licensor from granting licenses to anyone else. These terms do not imply any other licenses.

Patent Defense

If you make any written claim that the software infringes or contributes to infringement of any patent, your patent license for the software granted under these terms ends immediately. If your company makes such a claim, your patent license ends immediately for work on behalf of your company.

Violations

The first time you are notified in writing that you have violated any of these terms, or done anything with the software not covered by your licenses, your licenses can nonetheless continue if you come into full compliance with these terms, and take practical steps to correct past violations, within 32 days of receiving notice. Otherwise, all your licenses end immediately.

No Liability

As far as the law allows, the software comes as is, without any warranty or condition, and the licensor will not be liable to you for any damages arising out of these terms or the use or nature of the software, under any kind of legal claim.

Definitions

You refers to the individual or entity agreeing to these terms.

Your company is any legal entity, sole proprietorship, or other kind of organization that you work for, plus all organizations that have control over, are under the control of, or are under common control with that organization. Control means ownership of substantially all the assets of an entity, or the power to direct its management and policies by vote, contract, or otherwise. Control can be direct or indirect.

Your licenses are all the licenses granted to you for the software under these terms.

Use means anything you do with the software requiring one of your licenses.

This agreement is between Enrique Pina (the "Licensor") and the person or organization that obtains a SuperScheduler Pro subscription ("you"). By downloading, installing or using the Software you accept this agreement. If you accept it on behalf of an organization, you confirm that you are authorized to bind it, and "you" means that organization.

1. Definitions

"Software" means SuperScheduler Pro: the package named super-scheduler and every version of it that the Licensor makes available to you, with its documentation. Your subscription also covers SuperScheduler Lite (the package super-scheduler-lite) as described in section 3.4.

"Subscription Term" means the twelve months for which a subscription has been paid, starting on the date of the invoice, and each further twelve-month period for which it is renewed and paid.

"Licensed Developer" means an individual who writes, changes or maintains source code that uses, configures or calls the Software. Build and test servers, and people who only use an application that includes the Software, are not Licensed Developers.

"Your Application" means a software product, website or service that you develop and that adds substantial functionality of its own beyond the Software.

2. Subscription and fees

2.1 Each Licensed Developer needs one subscription. The price is EUR 499 per Licensed Developer per Subscription Term, plus applicable taxes, unless a different price is agreed in writing.

2.2 You must hold at least as many subscriptions as you have Licensed Developers. You may reassign a subscription to another individual when the original Licensed Developer stops working with the Software.

2.3 Fees are paid in advance against the Licensor's invoice. They are not refundable, except where the law requires otherwise.

3. License

3.1 Subject to this agreement and to payment of the fees, the Licensor grants you, during the Subscription Term, a non-exclusive, non-transferable, worldwide license for your Licensed Developers to download, install, use, copy and modify the Software in order to develop, test, build and run Your Applications, including commercial ones.

3.2 During the Subscription Term you may distribute the Software, or let others access it, only as an integral part of Your Applications, in the form produced by your build (for example a bundled or minified script), and only for use with Your Applications. Your end users need no license of their own.

3.3 You may download the versions the Licensor releases during the Subscription Term. Download keys are confidential and are for your organization only.

3.4 During the Subscription Term, your Licensed Developers may also use SuperScheduler Lite under the terms of sections 3.1 and 3.2, in addition to the licenses published with it.

4. Restrictions

You may not:

(a) distribute, sublicense, sell, rent or publish the Software on its own, or as part of a library, component, framework, template, SDK or other product whose purpose is to let others develop software with it;

(b) use the Software to create a product that competes with it, such as a scheduler, timeline or calendar component for developers;

(c) publish the Software's source, packages or download keys, for example in a public repository or a public package registry;

(d) remove or alter copyright notices or this agreement in the Software;

(e) use the Software in Your Applications beyond the Subscription Term, except as section 6 allows.

5. Ownership

The Software is licensed, not sold. The Licensor keeps all rights, title and intellectual property in it. Changes you make to the Software remain subject to this agreement. Your own code, outside the Software, remains yours.

6. Term and termination

6.1 This agreement lasts for the Subscription Term and continues for each renewal.

6.2 When the Subscription Term ends without renewal, all licenses under this agreement end. You must then stop using the Software, also in Your Applications in production, stop distributing it, and delete the copies in your possession, unless you hold another license that allows that use.

6.3 The Licensor may terminate this agreement by written notice if you breach it and do not cure the breach within 30 days of that notice. Licenses end on termination, with the consequences in section 6.2.

6.4 Sections 4, 5, 7, 8 and 9 survive the end of this agreement.

7. Warranty

The Software is provided "as is". As far as the law allows, the Licensor gives no warranty or condition of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and does not warrant that the Software is free of errors or will work without interruption.

8. Limitation of liability

As far as the law allows, the Licensor is not liable for indirect, incidental, special or consequential damages, or for loss of profits, revenue, data or business, arising out of this agreement or the Software. The Licensor's total liability is limited to the fees you paid in the twelve months before the event that gives rise to the claim. Nothing in this agreement limits liability that cannot be limited by law, such as liability for wilful misconduct or gross negligence.

9. General

9.1 This agreement is for business and professional use. It is governed by Spanish law, and the courts of Spain have exclusive jurisdiction over any dispute about it.

9.2 You may not assign this agreement without the Licensor's written consent, except to a successor of your whole business that accepts it.

9.3 The Licensor may publish new versions of this agreement. A new version applies to you from your next renewal.

9.4 If a provision is held invalid, the rest of this agreement remains in force. This agreement, with the invoice, is the entire agreement between you and the Licensor about the Software and replaces any earlier terms, including license metadata in earlier package manifests.
